5 Things You Need for Your Green Card Application

Obtaining a green card — lawful permanent residence in the United States — is one of the most significant steps in an immigrant’s journey. Whether you are applying through a family member, an employer, or another qualifying category, having the right documentation prepared can make the difference between a smooth approval and costly delays.

At Stephen Bandar Law Office, we have guided thousands of clients through the green card process over 23 years of practice. Below are the five most important things you need to have in order before filing your application.

1. A Qualifying Petition or Category

Before you can apply for a green card, you need to establish your eligibility. The most common pathways include family-based petitions (Form I-130), employer-sponsored petitions (Form I-140 or I-526), the Diversity Visa Lottery, and special categories such as asylum, U-Visa, VAWA, or SIJS. Each pathway has different eligibility requirements and processing timelines, so it is essential to determine which category applies to your situation before you begin.

If you are unsure which category fits your circumstances, a qualified immigration attorney can evaluate your case and recommend the strongest path forward.

2. Complete and Accurate Forms

The primary form for adjusting status to permanent residence is Form I-485 (Application to Register Permanent Residence or Adjust Status). This form must be filled out completely and accurately. Even small errors — a misspelled name, an incorrect date, or a missing signature — can result in a Request for Evidence (RFE) or outright denial.

Depending on your situation, you may also need to file Form I-130 (Petition for Alien Relative), Form I-765 (Application for Employment Authorization), Form I-131 (Application for Travel Document), and Form I-864 (Affidavit of Support). Each form must be consistent with the information on your other filings.

3. Supporting Documentation

USCIS requires extensive supporting documents to verify your identity, relationships, and eligibility. Commonly required documents include:

  • Birth certificate (with certified English translation if not in English)
  • Passport and all previous U.S. visa stamps
  • Marriage certificate (for spouse-based petitions)
  • Evidence of bona fide relationship (photos, joint bank statements, lease agreements)
  • Financial documents proving the sponsor meets income requirements
  • Police clearance certificates
  • Two passport-style photographs meeting USCIS specifications

Missing even one document can significantly delay your case. We recommend preparing a complete document checklist specific to your category well in advance of filing.

4. Medical Examination Results

All green card applicants are required to undergo a medical examination conducted by a USCIS-designated civil surgeon (Form I-693). This examination checks for communicable diseases, ensures that required vaccinations are up to date, and screens for any physical or mental health conditions that could affect admissibility.

The medical exam results are valid for two years from the date of the civil surgeon’s signature. We recommend scheduling this appointment early in the process so the results are ready when needed but still within the validity window when your case is adjudicated.

5. An Experienced Immigration Attorney

While it is technically possible to file a green card application on your own, the stakes are simply too high for most people to risk. Immigration law is complex, and the consequences of mistakes can range from months of delays to outright denial or even triggering removal proceedings.

An experienced attorney will review your complete case history, identify potential issues before they become problems, prepare your forms and supporting documents meticulously, and represent you at your interview. The right legal team can make a stressful process much more manageable.
