The timeline varies depending on whether you file affirmatively with USCIS or defensively in immigration court. Affirmative asylum interviews can be scheduled within weeks to months of filing, while court cases may take one to several years. You may apply for an Employment Authorization Document (EAD) 150 days after filing your asylum application, and USCIS must adjudicate it within 30 days after that. Once you receive your work permit, you can legally work anywhere in the United States. We help you file for work authorization as soon as you are eligible.

If USCIS denies your affirmative application, your case is typically referred to immigration court where you will have another opportunity to present your claim before a judge. If the immigration judge denies your case, you can appeal to the Board of Immigration Appeals (BIA) and even to federal court. Our firm handles asylum cases at every level.
